BABY BOTANICAL, SL is the owner and manager of the official online sales website "www.babybites.shop" through which BABY BITES, SL products are offered for sale to companies and self-employed individuals.

These General Conditions of Purchase govern, without restriction, the sale of products made by BABY BOTANICAL, SL from the indicated website. These conditions may be printed and stored by Web Users by clicking on the following link: "GENERAL CONDITIONS OF PURCHASE."

2. SCOPE OF APPLICATION. ACCEPTANCE OF THE GENERAL PURCHASE CONDITIONS

These General Conditions establish the conditions for placing orders, payment, and delivery of the products ordered, as well as the management of potential responses to them.

5. CONTRACT (order placement)

To place an order, you must follow the online purchasing procedure and click on the acceptance of the GENERAL PURCHASE CONDITIONS.

After this, you will receive an email acknowledging receipt of your order (the "Order Confirmation"). All orders are subject to our acceptance, of which you will be notified via an email confirming that the product has been shipped: the "Shipping Confirmation." The contract for the purchase of a product between you and us will be formalized only when we send you the Shipping Confirmation.

Only those products listed in the Shipping Confirmation will be subject to the Contract. We will not be obligated to supply any products that may have been ordered until we confirm shipment to you in a Shipping Confirmation.

Please note that the Shipping Confirmation will be sent to you within 48 hours of placing your order if you have chosen home delivery or collection at a Post Office or Punto Pack store.


6. AVAILABILITY OF PRODUCTS

The complete processing of your order is subject to the availability of the products ordered. If, at the time of preparing your order, we do not have the product you require in our warehouse because it is out of stock or because we consider the product to be unsaleable, we will inform you and refund the amount you paid for it within a maximum of seven days from the date we inform you that the product cannot be delivered.

In any case, we will inform you of any changes that may occur to your order due to unavailability of items.

7. DELIVERY

BABY BOTANICAL, SL works on a cash basis . Therefore, we ship orders once we have received proof of payment or deposit into your account. Please note that deliveries will not be made on weekends or holidays.

For the purposes of these General Conditions, "delivery" or the order being delivered will be deemed to have occurred upon signing for receipt at the agreed delivery address.

8. PRICE, SHIPPING CONDITIONS AND COSTS AND PAYMENT CONDITIONS

8.1 PRICE

The price of the products will be as stipulated at any given time on our website. Obviously, the price and other conditions of the items you have ordered from us will not be modified during the period between your offer and our acceptance via the shipping confirmation, unless we are required by law or by a government agency to make retroactive changes to these policies, Terms and Conditions, or Privacy Statement, in which case, any changes will also affect any orders you have previously placed.

The prices shown on the website are indicated in euros and include any discounts and VAT applicable at the date of the order. Shipping costs are not included, as indicated in the following section.

Likewise, it is indicated that BABY BOTANICAL, SL will inform its customers of the period and discounts applicable to each season's sales.

In addition, BABY BOTANICAL, SL has the right to make specific promotions and discounts and undertakes to apply the same actions and discounts to its customers.


8.2 SHIPPING CONDITIONS AND COSTS


Delivery times are 3-7 days after payment has been made. In the unlikely event of a delay in delivery, BABY BOTANICAL, SL is not responsible. However, the company will take appropriate action to resolve the issue as quickly as possible and ensure this problem does not occur in future shipments.

8.3 PAYMENT TERMS

BABY BOTANICAL, SL does not receive or store your debit or credit card or PayPal account information. You'll know the page is secure by the padlock displayed at the bottom of your browser (or if the website address begins with https). This method is the recognized standard for secure transactions.

By clicking "Authorize Payment," you are confirming that the bank card is yours. Bank cards are subject to verification and authorization by the card issuer, but if the issuer does not authorize the payment, we will not be liable for any delay or non-delivery, and we will not be able to enter into any Contract with you.

After confirming your order, BABY BOTANICAL, SL will send you a confirmation message informing you that your order has been duly registered. The transfer of risk of loss and damage to the products will occur after delivery and receipt of the Products by the Customer.


9. RIGHT OF WITHDRAWAL

You have the right to withdraw from this contract within a maximum period of 14 calendar days without giving any reason.

The withdrawal period will expire 14 calendar days from the day on which you or a third party indicated by you, other than the carrier, acquired physical possession of the goods.

To exercise your right of withdrawal, you must notify BABY BOTANICAL, SL, located at Calle Escola Pia 94, Esc A7, 80201 – Sabadell (Barcelona), of your decision to withdraw from this contract by means of an unequivocal statement (for example, a letter sent by post). You can also inform us of your right to withdraw from this contract by emailing info@babybites.es.

You may use the model withdrawal form below, although its use is not mandatory. To comply with the withdrawal deadline, it is sufficient for you to send your communication regarding your exercise of this right before the corresponding deadline expires.

Consequences of withdrawal
If you withdraw from the purchase, we will refund all payments received from you, including the initial shipping costs for your order.

We will refund you within a maximum of 14 calendar days from the date we are informed of your decision to withdraw from this contract. However, we may withhold the refund until we have received the goods back or until you have provided proof of their return, whichever is met first.

We will process the refund using the same payment method you used for the initial purchase, unless you have expressly agreed otherwise; in any case, you will not incur any costs as a result of the refund.

In case of withdrawal, you must return the products to us and bear the direct cost of the expenses generated by the return of the products to:

You can also exercise your right of withdrawal by contacting info@babybites.es or to Calle Escola Pia 94, Esc A7, 08201 – Sabadell (Barcelona), in which case the exercise of the right of withdrawal will not generate any type of expense for you.

You will only be liable for any decrease in the value of the products, from the time you receive them until you inform us of your withdrawal, resulting from handling other than that necessary to establish the nature, characteristics, and functioning of the products.
The right of withdrawal does not apply to contracts for the supply of sealed goods that are unsuitable for return due to health protection or hygiene reasons and that have been unsealed after delivery.


10. EXCHANGES AND RETURNS

The following conditions regarding exchanges and returns of our products do not apply to exercising your right of withdrawal. If for any reason you are not satisfied with your order, you have 30 days from the date of delivery to exchange or return the product.

The date shown on the delivery note will be used as a reference for calculating the thirty-day period.
For any exchange or return, the product must not have been used and must be returned in perfect condition, including tags, instructions, and warranties (if applicable).

Refunds will be issued within a maximum of 30 days from the date the order is returned and using the same payment method used to pay for the purchase (bank card), unless you choose a different payment method.

If you paid for your order through your PayPal account, we will credit the amount to your PayPal account.

The following cases are excluded from the money-back guarantee:

- For hygienic reasons, toiletries, pillows, harnesses, sleepwear, support belts, positioners, eating aids, cushions, mattresses, and other anti-bedsore products cannot be returned if they have been removed from their original packaging.
- If the product, once delivered, suffers deterioration caused by external events, accidents or failure to follow the instructions for use.
- If the product is damaged due to incorrect installation or configuration of accessories by the customer.
- If a breakdown occurs due to a component not supplied by us.
- If it is a custom-made or personalized product.
- In the event that the manufacturer's general conditions so indicate.
- If the product is not in perfect condition and with all the original contents.
- If the packaging has not been protected so that we receive it in perfect condition.

11. RESPONSIBILITY AND WARRANTIES ON OUR PRODUCTS

The legal warranty applies from the date of delivery of the product for a period of two years, within two months of the discovery of the defect. Within the first six months, BABY BOTANICAL, SL must provide proof of the absence of a defect; then, the customer must provide proof of the existence of a defect in the product within the following 18 months.

The warranty will not apply in the case of:

- Modification of the product by the customer.
- Normal wear and tear of the product.
- Improper use of the product.
- Failure to comply with product maintenance rules.
- Damage caused by transport or storage of the product.

When a product defect is proven, replacement or repair will be made free of charge, except where the cost is disproportionate to the damage or if it is impossible. If this is not possible, BABY BOTANICAL, SL will provide a partial or full refund, as appropriate. When a lack of conformity is proven, replacement or repair will be made free of charge to the customer and without any obligation to provide a time limit. Finally, please note that BABY BOTANCIAL, SL is not responsible for any misuse of the products. Parents, guardians, or those responsible for supervising and/or caring for the baby will be solely responsible for any damage resulting from misuse of the product or negligence in caring for the baby.


12. OUR RIGHT TO MODIFY THESE TERMS

BABY BOTANICAL, SL reserves the right to review and modify these Conditions at any time.

However, the price and other conditions of the items you have requested will not be modified during the period of time between your offer and the acceptance of the same issued through the shipping confirmation, unless by law or decision of government agencies we must make retroactive changes to said policies, Conditions or Privacy Statement, in which case, possible changes will also affect orders you have previously made.

Submitted offers are valid for 15 days from the date of issue. If payment is not received within this period, they will be automatically deleted.


13. APPLICABLE LEGISLATION AND JURISDICTION

The use of our website and any product purchase contracts entered into through said website shall be governed by Spanish law.

The resolution of any type of controversy, dispute, or discrepancy that may arise between the user and BABY BOTANICAL, SL due to the use of this website shall be submitted to the competent Courts and Tribunals in accordance with current legislation.

To this end, the ONLINE DISPUTE RESOLUTION organization was created, which will act as a neutral party and valid interlocutor between both parties, largely attempting to avoid resorting to the courts.
